The Firm

Much like some Western legal principles, “virtus” has its roots in Latin. In Ancient Rome, virtus represented sought-after qualities like bravery, character, and excellence, specifically demonstrated in service of the public. Virtus laid the foundation for the concept we understand as “virtue” in today’s English.
At Virtus Counsel, we aim - as the ancient Romans did - to pursue “virtus”, adopting those principles to advocate courageously, act honourably, and advise virtuously.

In Mandarin, 威 is pronounced wēi (like “way”), and 德 is pronounced dé (like “duh”). In Cantonese, 威 is pronounced “wai” (like “why”), and 德 is pronounced “dak” (like “duck”).
威 as an adjective is used to describe something that is mighty.
Aptly, 德 is defined as virtue, morality, ethics, and character.

That beast is known as 獬豸(xiè zhì) in China, “kaichi" in Japan, and “haetae” in Korea. It is sometimes called the “sagacious stag”. As a mythical creature, it is now used across many countries of Asia as a symbol of justice. According to legends, this creature had a natural ability to tell right from wrong.

We also offer fractional legal counsel services, where we provide on-demand part-time in-house counsel support to growing businesses as needed. These services could include support in contracts, corporate governance, compliance, privacy, licensing, e-commerce, and litigation support.

When you retain us, we will have a conversation about communications, at which time you can let us know what is ideal for you. Our preferred method of communication depends on the circumstances, but it is generally by email.

We have seen a wide spectrum of preferences on reporting. Some clients have wanted weekly updates while others have only wanted to hear from us quarterly. The topic of reporting is one that will be discussed between you and the responsible lawyer on your file when you retain us.

In litigation and business, many things are best done “yesterday”. We recognize that your business’ projects and issues are critical to you. So, we will treat it accordingly to address emergencies as they arise.

As much as Google, articles, and forums can tell you, we believe the best way to find certainly is to speak with professionals like us. An initial consultation is a low commitment way of determining whether a lawyer is necessary (and we would tell you if it is not).

Depending on the specific circumstances of your matter, we could offer one (or a hybrid) of the following methods:
Hourly rate: This is what you will find most commonly in litigation, where your business gets billed according to a lawyer’s hourly rate in increments of a fraction of an hour.
Flat rate / fixed fee: For more predictable matters (like our fractional legal counsel services), we can discuss a flat rate so you can get a concrete sense of your legal spend.
Contingency: This is an option where you will not pay any legal fees unless you are ultimately successful in litigation or reach settlement but is only available in limited situations.

Yes! Flat fee (i.e., fixed rate) or other billing arrangements can be made when it is appropriate for the matter.

There are many factors that contribute to the cost of litigation. Some of the common factors include the kind of claim you are pursuing or defending, the complexity of the matter, and whether the matter resolves by settlement or trial.

Generally, lawyers will ask you to deposit a sum of money into a their trust account upon retaining them. This is common practice in matters billed on a hourly-rate basis.
Your retainer is like gas in a vehicle. As your file progresses through the work of legal professionals, the law firm will bill invoices against the retainer in trust (like using up gas to get somewhere). When the tank is empty, work will typically not proceed. You will need to refill the retainer before more work can be done.
It is usually a good idea to ensure there is gas in the tank so progress on your matter does not come to a halt. This may not be a format many are familiar with, so we recommend you contact us for more details.

As identified above under “What factors affect the cost of litigation?”, there are many considerations coming into play on a litigation file. Many of those factors fall outside of our control (for instance, how often opposing counsel communicates, how many attempts it takes for our application to be heard in court, how cooperative the opposing parties are about disclosure, and many others).

Disbursements is a term that essentially captures any out-of-pocket expenses that we pay on your behalf, such as filing fees, photocopies, postage, court reporter fees, and others. These expenses will be billed back to you While taxes may be applicable, we do not apply any additional markup to such expenses.

Our initial consultations are booked for 15 minutes, and we do not charge for that time. However, we will charge for any additional time beyond that.

Payments are uncomplicated as we accept cheque, bank drafts, bank transfers, wire transfers, e-transfers, and credit cards.

Many factors go into this, some of which include the type of claim you wish to make, the complexity of the matter, and whether the matter settles. The court in which you file your action can also have a significant impact on how quickly a matter resolves.
We have experienced matters resolve within a week, not even needing a claim to be filed. Other times, we have seen matters taking nearly a decade to reach resolution.

This depends on the type of claim, but at a minimum we suggest having all of the following relevant documents would be helpful:
contracts
correspondence (emails, letters, text messages, social media messages)
multimedia (videos, photographs)
financial documents (invoices, receipts, statements, sheets)
reports (appraisals, valuations, studies)

Generally, it is possible, but the court will rely on an established set of factors to determine how much you can recover (it is unlikely the full amount). In some cases, it is written into a contract that the parties agree to a certain level of legal costs recovery. Assuming that clause is valid and enforceable, the parties can feel more confident about being awarded a defined level of costs.

Fractional Legal Counsel

Fractional Legal Counsel are contractors, not employees. They do not have to work a typical 40-hour week at your company like in-house counsel would. Fractional Legal Counsel provide your company with the support you need, only to the extent that you need it; be it 4, 10, or 27 hours a week.

They can integrate in your company the same way an in-house lawyer would. They study your business teams, learn the ways in which your company operates and competes on the market, and provides critical legal support on a range of matters relevant to your business.
